Tearing without max framerate

I am having a real odd problem with some code i am using in a game. I update my logic then draw the objects,ect then i flip. I move all my objects by time not framerate. However any time my fps is less than my max refresh rate i get alot of jerkyness ect. Any idea how to fix this?
