is it illegal to sell games made with the d3d framework or the samples?

I belive it is legal to do so unless you mean selling them using the same graphics/sounds which i think are copyrighted.

i just mean the cmyapplication class and d3dutil libs

Yes, thats totally legal unless you keep the graphics, as said earlier.
