But in that case, the emblem could be pretty much anything, even a person or character, as long as it is distictive for the game. For example, in the case of Mario, the strongest recognisable symbol is Mario himself.

Could one's horoscope sign be considered an emblem in accordance with the 4E5 rules?

Yes, but as I've said several times, if you're going to use an existing symbol then you need to imbue it with some extra significance of your own. (For example, you could make it the sign for the player character and make the fact that that's their sign of strong importance in the story).

What if we modify the emblem at a later time (like 3/4 the way through the game)? Ala "you thought it was this, but it was missing 2 pieces!" So, the same emblem with a couple modifications.

Sounds reasonable. You'd be using the same emblem, you'd just be drawing a couple extra bits on top.

Can an emblem be a flag, or flags for that matter?

Yes. However, you need to be sure that you have at least one flag that is emphasized above the others, and that you add some kind of extra significance to it. So when you use the flag in your game, it has to mean more than simply "french flag" or "german flag."

Correct me if I'm wrong.

The game design I had in mind would have a hand full of primary emblems for the factions in the game. From there users could customize their own emblem but would still remain a member of one of these faction. So the icon for the game as well as the initial splash screen could be one of these primary faction emblems. However after you selected a character it would switch off to using that characters emblems for load screens in game.

In game you would see emblems of the main factions, however depending on where you are would determine the emblem you see.
